Car accident where other side insurance accepts fault. With own insurance we have plan for rental. Shouldn’t this be offered by at fault party’s insurance company? Is it typically not unless asked? Even if insurance says accepting fault, I am hesitate to pay anything myself and hope they reimburse as they should and say they will- can you ask to be paid upfront the case amount for rental instead?
For medical- getting pressured to say what’s wrong, when medical appt are, etc. From small amount of online research sounds like I have right to tell them I will come back to them once I know more and have no obligation to give moment by moment updates — and then just need to submit all long before statute of limitations runs. Does that sound right? Again, other side insurance said they are accepting liability already but so far said nothing else but givigg by a car shop for estimate. Thanks, |

| We just went through this. (Although other driver has not yet accepted fault despite clear photographic evidence and police report showing fault). I just dealt with our insurance company. They paid repairs/ medical etc. then they go after other insurance. We did have to pay deductible on repair but we are supposed to be reimbursed once the other driver/insurance company acknowledges reality. |

Party at fault and party damaged are with same insurance. Insurance “loses”either way and so not same set up where they fight for you to get other insurance to pay. |

I went through this recently. Honestly, if there are any injuries just get a lawyer. As soon as the lawyer contacts the insurer they can’t speak to you anymore. It’s fantastic and just makes your life so much easier.
As far as paying, just get the rental from yours if it’s offered quicker. Pay for your med bills with your medical insurance. Once everything is settled (which can be awhile if your injuries aren’t clear cut), everything will get paid back. Better than stressing about it now. Is your car totaled? For me, that took a few weeks- maybe even a month- but it was handled first by the other person’s insurance. They didn’t want to call it totaled right away even though it was obvious, so I had to push the adjuster a bit to get the estimate done. Once it was declared, I got the money pretty quickly, but that was stressful. |

| Thanks for all replies. Sorry others had to deal with too and hope all doing better from when happened. Will not take any further call. In first call, would at fault party’s insurance ask for injured party birthday? And SSN? Did not give but they said they did “data fill” and found it?? |

I always use our own insurance. Which will then seek reimbursement from who was at fault's insurance. This route removes you from having to give statements. I also have a good lawyer that's assisted. Good Luck. |
