Timing for Supreme Court?

Any guesses on when the admin will bring the mass layoff case to the supreme court? And how long this might go on for?

Like many of us, I'm a fed that's been in limbo since this insanity began. I'm just ready for a resolution.

Don't hold your breath.

The wheels of justice turn slowly, even with things that are fast-tracked.

Ok, I sure won't. Still, would be nice to know if we're talking weeks, months or years.

I actually think the SC emergency motions have been heard relatively quickly. Again not a decision on the merits but if they do not stay the PI the RIFs will not happen for a long time and potentially not at all. If they grant a stay I would expect the RIFs to move forward quickly.

Thank you. I'm not familiar with how this works, so this is helpful. When will we know if they grant a stay?

My best guess is within a month or two. Remember it's not a decision on the merits only whether the RIFs can proceed while the litigation is pending. Note also their are other cases affecting different agencies so this might not be the only one that affects your status.

Do people who were going to be rifD today get pay and benefits while they decide?

Yes, the injunction prevents them from RIFing you right now if you are at one of the covered agencies.

They just appealed just now. TBD on when the court will take it up.

Do you know if they have to start over with a 30-60 day notice, or if the government wins will they back date the rigs until June 2nd?

Put this in too soon could there be a clawback?

They can't claw back your pay and make your RIF date retroactive. Not sure but I don't think they need to give you a new RIF notice. They need to give you at least 60 days' notice and I think they fulfilled that requirement even if you ended up with more time.

So we should get an answer after June 9?

OP here. The latest is the plantiffs have until Monday to respond. Then we'll have more information.
