It's not illegal. Trump is in charge of it and has the authority. What can happen is that the necessary programs like FAFSA, Pell grants, etc. can be sent out to contractors or back to HEW/HHSwhere ED came from (HEW). Unnecessary programs (and there are many) return to the states. I was a high ranking officer there supervisong over 100. They could all be fired tomorrow .. all of them. The waste and bloat was unbelievable. |
Well your response wasn't actually helpful or factual. Closing the Dept requires an act of Congress and a supermajority at that. It is illegal for the President to impound funds that Congress has appropriated. The employees are civil servants and have protections under the law, so firing them without cause is illegal.

Ideally Congress would send the money to other departments to perform the same jobs. However, if they didn't, states and thus schools would lose the funds. The President can't close the agency because it was created by Congress, but what he will do is basically make it non-operational like putting folks on Administrative leave and then suggesting to congress to move the funding. So write you Congressperson and Senators. |
They contract out the programs that are deemed necesarry. Or they are sent back to HHS, or sent to the states, which is sensible because the state voters know best what they want for third-party financing and choice issues. |
Probably civil rights matters go back to DoJ, where they originally were before DoEd.
Most of the rest probably goes back to HHS, which is where they started (HHS was called HEW before Ed was split out). |

Things are so bad and the DofE seems to have been the impetus for the decades-long downturn. What could POSSIBLY be worse than what all these "experts" have done to our once-great school system anyway? I say, get rid of them all and let schools be locally designed and run. |
