That’s not remotely right. It can both be true that Blake defamed Justin, in colloquial terms, and that her actions did not rise to the high standard we have for the cause of action of defamation. |
One reason I think Lively may have a stronger case than some people give her credit for is that Baldoni filed a $400 million complaint with no legal basis in order to try and combat it. This indicates to me that he's pretty scared of her claims getting to a jury.
I don't know if that fear is merited, but I do think it will come down, in large part, to witness testimony, including testimony of other members of the cast and crew, Sony producers, and other witnesses to the events Lively alleges in her complaint. And on that point, I will note that Liz Plank, who worked closely with Baldoni and Heath on their podcast for multiple years, today replied to a comment on her Instagram about today's dismissal with "lmfaooo." Plank may be a material witness in the case as it is suspected that she is the "mutual friend" who Lively texted during the early weeks of filming about Baldoni's and Heath's behavior and how she was going home crying at night because of it. I think some JB supporters may be surprised when third parties who were there start to weigh in on what happened here. |

To answer my own question, yes, she shares a business address with VanZan, has known Reynolds longer than she has known Baldoni, and allegedly played a role in Blake being cast in the the movie. |
She interacted with multiple parties during the time these events were going on. There's this very damning episode of the podcast where Baldoni spoke in vague terms about his experience with IEWU. He talks about how he was not happy with his own behavior and he had not been living up to his own ideals. He even mentions that his wife told him he should go back and read his own book. This was during the hiatus but I believe before the Jan. 4th meeting. Plank may also have been on set some days. In the text I mentioned above, Lively says that she wanted to invite the "mutual friend" to the set but things were so unpleasant that she was glad she hadn't invited her on that particular day. She may have been there other days and she may also have information about Baldoni's state of mind toward Lively during the time when the alleged retaliation was taking place. She definitely interacted with Heath during this time, as she was recording podcast episodes with him. There is also a fascinating episode of the podcast from around the time the film came out where Heath and Plank talk about consent, and some of Heath's comments on that episode are really... interesting in light of this case. Including his comments on a story Liz tells about dating a guy who was physically violent with her and whether she had "consented" to that violence (she had not). Plank may have been more "there" than you think. |
She is also the person who co-hosted the Man Enough podcast with Baldoni and Heath for several years prior to IEWU. I find it weird you'd leave that part out. |

Uh almost no one actually believes this deranged theory that Blake and Ryan "cooked up a hoax" to smear Baldoni. Why? To "steal" the sequel from him? It makes no sense. In fact, it makes so little sense that Baldoni doesn't even allege this in his complaint that was just dismissed, because there is absolutely no evidence that it happened. You will be shouting about this in your weird little corner of the internet while everyone else moves on with their lives unencumbered by silly conspiracy theories like this. Maybe join forces with the Pizzagate people if they are still kicking around, I feel like you guys would get along. |
