Got hit head on while waiting in turn lane, what can I expect?

Why? They will take at least 1/3 of the recovery and won’t get you an additional 1/3 more than the insurer will pay voluntarily.


I didn't find that to be the case in my situation. 100% other drivers fault. And I had medical expenses for months


I’m a lawyer. My kid had a very bad accident. The honest advice I got from attorneys that they could not do better for me unless we went to trial and that would involve out of pocket expenses including an expert and the result would be a crapshoot. They told me to take the insurance money offered.

And the lawyer will tell you to go through your insurance company. There's nothing to gain to go after a motorist with no money and apparently only car damage -- exactly what insurance is for. Where can I send my bill?

No lawyer necessary - there's no money in this case beyond what insurance will pay.

It is actually a blessing he did. It have insurance.

By law your insurance company will pay and uninsured motorist coverage means your rates won’t go up and quick payment.

If anything the other guy is really screwed car totaled, towing fees, big ticket driving no insurance. You should feel bad for him.

Just file your insurance. As long as multiple airbags did not deploy they can fix it.

The other driver seems honest and he admitted fault. And even if he had insurance his company is in no rush to pay you.

Uh, bad take in so many ways. Most importantly: how you’re covered and whether your rates will go up entirely depends on your policy.

Yea I don’t plan to go to trial. I don’t think there’s much we can really do. He doesn’t have any assets

Why didn’t the police ticket the bad guy pulling out as fast as he could from a strip mall and hit the passenger side front end of OPs car?

If he is indeed found 💯% at fault - then his insurance co. will likely offer you a settlement.

If you have collision/comprehensive then you may collect a settlement from your own provider.

But your vehicle will need to be seen by someone at an auto body shop in order to deem if your vehicle is indeed a total loss.

Even if you think it is not salvageable your insurance co. may say it can be fixed.
The insurance co. tries to do whatever is in their best interest vs. you + your children’s.

Police office cane kate to the scene. Another county’s responded first. The guy was cooperating and provided insurance information, got off with no tickets despite not having active insurance. He provided his plan that he was dropped from a while ago.

Yes hoping they total it. I don’t want to drive my kids in a car that’s been in a collision.
He doesn’t have insurance and it’s already been declared that he is at fault. He said so in his statement probably just trying to be cooperative and not highlight the fact that he doesn’t have insurance and has a record a mile long of duis and drug charges.

I don’t see what’s the big deal. Someone hit your car. No one is hurt. He admitted fault. File with your insurance they fix your car. Then your insurance company will decide if worth suing the guy to recoup their payout.

This is a civil matter between your insurance company and this guy. Why do you care?

Do you have an estimate yet? It doesn’t take much for an estimator to get to declaring the car a total loss. Especially if the airbags deployed, which must have been the case here if it was a head on hit and bad guy was traveling full speed from the strip mall.
