Got hit head on while waiting in turn lane, what can I expect?

I got hit head on while waiting in the turn lane. A car pulled out from a shopping center and made a left and only looked into oncoming traffic.
I was not moving and had the right of way. He saw me and slammed on the brakes and rammed into me head on/into the passenger side. His car was totaled beyond repair. My Chevy Tahoe looks ok but had a lot of front damage, the doors wouldn’t open on that side and I walked away without injury. It’s 2015 paid off 100k miles. Similar cars are about 25000 online. What can I expect from insurance for a situation like this? I have two young children and do not want to be stuck with a car with significant damage that’s unsafe. I feel like I’m going to be the biggest loser here even though I wasn’t at fault if they don’t risk the car. My husband thinks they may bc the frame seems bent. Any advice on what to expect?

He had insurance and I think he assumed liability. There’s not much to contest. We got photos and I am straight in the turn lane with the right of way.
Help! I’m so bummed. Not what I need right now!

First, were you seen by a doctor? Whiplash and other soft tissue injuries can come on a few days later.

Second, call your insurance so they are helping deal with the other carrier that is going to want to pay minimum.

Third, do not sign anything provided by the other insurance company out of the gate.

Fourth, keep screenshots or printouts of the cars you’re finding of comparable value. You will probably have to negotiate.

Because I was in a turn lane and he came out from a strip mall parking lot. If you’re in the street driving you have the right of way. People coming in from shopping centers on the sides of the road have to be aware of the traffic in the road. Definitely one hundred percent not at fault. He pulled head on into my car going left when I was already in the lane.

Great advice so far.

Some insurance companies honor their claims, while others try to frustrate the victim into accepting an insufficient settlement. Contact your auto insurance company immediately. They have claims people & attorneys who should help you to receive a fair settlement with a provision for any delayed medical / personal injuries.

Everything will depend on insurance. I’d report it to both his and your company. One will send an appraiser. If it’s drivable you can take it to your own repair shop where an estimate will be done.

If you carry collision coverage, you’ll be fine. But if you don’t and the other driver has minimum coverage, you could end up with only $15k.

The other thing is you might feel fine now but you might not tomorrow.

And as for your car, no way to tell if it’s totaled until a professional looks at it.

I was in the center turn lane (used by both sides of the street)
I was not moving. He looked right into oncoming traffic but didn’t look left into the turn lane.
He literally pulled in head on from a strip mall
shopping center. The street has the right of way always. If you’re turning into traffic coming from a strip mall you need to make sure it’s clear. Even the police officer said so and he apologized on the scene. I don’t think there is any argument that I am at fault. There are photos showing my tires completely straight in the lane and him coming from a head on angle.

I turned left and was waiting in the center turn lane used by both sides of the highway for it to be clear to merge into traffic. He came from a strip mall parking lot and hit me head on in the center lane.

Read the boulevard rule. I was waiting in the middle of the street and he was turning directly into my unobstructed car.. head on. From a strip mall. People in the road ALWAYS have the right of way.

The Boulevard Rule is a colloquial name for a law that requires vehicles entering a roadway to yield to all vehicles that are already on that roadway.

And the two exceptions are: last clear chance (to avoid an accident) and contributory negligence. Don’t know enough to know if either applies but best guess is no because these excepts are hard to prove. I think for this discussion, it’s safe for us to assume OP is in the clear.
