Chevy Malibu lemon what to do

Anonymous
Bought used Chevy Malibu. Out of warranty zone now. There is an engine brake problem that is at the beginning of class action status. Our car has been out of commission for 28 of the last 40 days. Of course, I still owe on the car.
The dealer is dealing with GM for repair guidance . WHat can I do? I’m literally stumped. We are out of Maryland lemon law timeframe. Does NTSB take these issues? It appears to be headed toward a nation wide recall.
I can’t afford an attorney not sure what one could even do against GM .
What should I do?

If the dealer is working with GM and you have no lemon law recourse then I think you are stuck. If there are recalls. etc. you should be getting notices from GM.

You can work with the dealer to trade in the car before making repairs. Get a different car.

I wouldn't donate the car if you still owe on it.

Tell the dealer you're interested in purchasing a new/used car for a trade in.

The dealer can make the repairs at such a low cost, and then turn around and sell it and still make a profit.

I've never done this before myself, but I think you can roll your current loan into a new loan for the new/used car.

If you still have a car payment, what difference does it make? Just tell the dealer you want to keep the car payment what it currently is, and you'll just owe a bit longer on a newer/used car.

+2

Did you buy it from GM or a private dealer or off of Craigslist? Whose "warranty" is this?

Are you out of the warranty zone bc of its milage? Or bc the warranty doesn't cover engine problems?

Used cars are never covered by lemon laws so that was never an option. Unfortunately, the only thing you can do is to sell it or trade it in and take a loss. I'm sorry.

Used cars are covered by the law if they are new enough, but they have to be nearly new. Unfortunately, except for their Silverado trucks, Chevys are pretty junky cars.

Sometimes. If the car is sold with the manufacturer's warranty it's covered under the lemon law.

I bought a used 1999 Malibu in 2000. It lasted me until 2015. Not too bad. Chevy Malibu's are no better or worse than many other cars out there.
