| I purchased a foreclosed condo in acution. There are some hiccups and it is taking longer to complete the sale than anticipated. What are my options for evicting the (owner) occupants in the interim? |
| Doesn't a bank now own it? |
There are substitute trustees on the current deed. |
| I can’t imagine you have any ability to do that before closing the sale. |
| This is state specific but I don’t think you have any rights to exercise until you legally own the property. |
| You don't own it until you have the deed. Therefore you can't do any evicting until you own it. |

I've been to landlord tenant court many times, and they've never asked to see a deed. You have a bill fo sale showing ownership.
Depending on the state, eviction can take months. Best to start the process now. |
But OP doesn't own the condo. A bank does. The bank probably doesn't give a Phuk. |
| Just try it -- maybe it works, maybe it doesn't. The worst thing that happens is a court tells you to wait. |
But you have to assert you are the owner in your complaint or petition. OP cannot do that. |
| With all due respect, why the rush? You bought the property from an owner who probably has problems far worse then you. What goal do you have? What is the cost of waiting? You knew the risk of foreclosure purchases, so don't say to start repairing. |
I think wanting a house to be vacant and free of squatters the moment you own it is reasonable. But OP probably won't be able to have that. |
OP doesn't give a %^& about the owner possibly falling on hard times -- just want to kick them out before even owning it. |
Yeah cry me a river for OP
You don't own the property OP. Gotta wait in line like the rest of us mere mortals |
It’s not reasonable for someone who’s buying an occupied REO from the bank. OP, best you can do is get all your ducks in order so you can file for eviction after you close. You can’t do anything until you do. |
