DeSantis requesting medical records

DeSantis gave a deadline for Florida's public colleges to turn over the medical records of students experiencing gender dysphoria and seeking gender affirming care. The article says that in addition to the records they want ages of the patient and the dates they received treatment. Gender dysphoria has both a DSM diagnosis (for counseling) and an ICD 10 diagnosis (for medical issues) so I'm not clear if the records are being pulled from the counseling center, the medical center, or both.

Insider has confirmed that University of Florida, Florida State University, University of Central Florida, Florida A&M University, Florida International University, and the University of North Florida have complied with the request, but has yet to hear back from the rest.

I suspect they're going to try to pass a law(?) that public university funds from free counseling/medical services can't be used to treat gender dysphoria/provide gender affirming care. I don't get how turning over medical records is legal. When I was a counselor, those records included session notes.

I would avoid using college services for these issues in Florida or anywhere else at this point. This country has lost its mind over these issues. Help your child privately if possible.

It definitely doesn't seem legal to me. It's why Texas was targeting drivers license gender changes rather than the private medical records of adults.

They may be writing a law or something but I'm not sure why they would need people's records to do that? It actually screams making lists of undesirables. Last year there were people in FL talking about making lists of all the trans people in the state. It's really weird that they would need to identify all trans people unless they plan on targeting them specifically with something.

PII will probably be redacted. If it isn't then the schools have violated federal law and some students are going to get some nice payouts.

Article doesn't state that. I guess we'll have to wait until everyone involved is sued to find out. They're asking for five years of medical records. They really hate trans people. These are adults. Some in their 20's at this point.

That was my guess too, but the article teases out "medical records" from ages and treatment dates. True medical records would need a lot of redacting to remove identifying information.

And why isn't HIPAA an issue?

We're going to look back on this in a few years and see how close to Nazi Germany Florida became under DeSantis. I don't think the average person realizes how truly horrific it is.

My god. Well, there goes the idea of people withholding treatment from trans kids because they’re not adults, and it not being transphobic but about protecting children. Most college students are adults. This is what we worried about. I wonder what the next step is.

You’re assuming they won’t prevail and we’ll be here in a few years to look back. Someone will look back, some people are standing by and seeing it now. Too many are encouraging it. Far too many are being silently complicit. They (conservatives, not necessarily in Florida at the moment) are chipping away at marriage equality. Reproductive health is at risk. It’s a mess.

It is alarming to see him characterize his actions as a defense of freedom.

And I'm really disappointed in the school medical/counseling professionals that allowed this information to be turned over. Ethical guidelines should have required DeSantis to come in with a court order before any information was released.

+1 My kids aren't trans, but this is a slippery slope. Yet another reason my kids don't want to go south for college.

There is a family in TX with a trans kid who had to move to CA due to TX draconian laws. These types of laws, like abortion laws, don't impact you until it does. Then what?
