Take Care of Maya

It freed her daughter. Beata died, and five days later suddenly DCF believes Maya had the same condition Beata said she had all along and Maya gets to go home. If I believed my daughter was being sentenced to a slow and painful death because of the hospital abducting her,* I would do the same thing. Especially when it became clear CPS was targeting her and trying to turn her family against her.

*In Beata’s case, the doctor literally said this - she wasn’t making it up or overreacting or being mentally ill.

She is the mother of another child though. I feel so bad for her son. His entire life, his mom probably neglected him while obsessing over Maya. And to make it even worse, she decides that ultimately, he's not even worthy of having a mom.

If I believed my child was dying a slow and painful death I would cooperate to regain custody and I would parent my other child.

Is there a cultural element to this? Was Beata’s bluntness and “aggression” partly due to different styles of communication between Poles and Americans? I ask because I had some similar interactions with the mother of a student who was Ukrainian. May be just a coincidence. I know too at my workplace there are are often cultural misunderstandings between American staff members and other staff from another country (not Slavic.)

Also as I keep watching through to the end the documentary itself seemed another form of abuse. Showing the kids crying when the case is canceled again and they’re retreating to their rooms to try to cry away from cameras. So uncomfortable. Let them have their privacy to grieve.

That part was ridiculous. Legally, both sides knew the case wouldn’t go forward that day. Listen to the judge’s words. The only way it would have is if the family was willing to drop the punitive damages request. If not, no evidence could be heard. How could the judge or lawyers allow one side only to talk to the court: without it being a trial, without the other side being able to put in evidence and without being prepared, without the courtroom being available and open as it was likely scheduled for a 15/30 minute hearing, etc? Both sides had to know this - 100%. So either they have an attorney who communicates ineffectively or, most likely, this was done for dramatic effect knowing it would upset the kids and get captured on film. There is no other explanation.

Any lawyers here? It looks like perhaps Hopkins proposed a settlement on 7/28/23:

OK, looks like the site didn’t allow the link to be copied. Trying something else:

You can just go to the main clerk of court website and type in Jack Kowalski without registering. Scroll all the way down to exhibits (little green folders). There is a hearing scheduled for 8/2/23 so should be interesting!

the Kowalski family was awarded approximately $211 million in compensatory damages and the hospital was found liable on all seven of the claims against them, including false imprisonment, battery and intentional infliction of emotional distress.

The hospital should have settled. Bad move.

I've been following the Reddit thread about this case, and quite frankly, I'm shocked that the family won. There is much more to the case that was presented in the documentary. With that said, I'm happy for the family. More than anything, they appear to be seeking validation, so this verdict should help.

That's great news!

Unbelievable what some child abuse doctors are doing. Here is a case in San Diego that is similar to Maya’s. A girl had a 100% legit diagnosis of medical condition that causes dislocations and broken bones. Her treating physicians said there was no child abuse but the child abuse doctor said it was munchasen by proxy. They filmed her without her consent in the hospital for 38 days and got a judge to removed her from her parents care.

I'm not shocked - it's a jury trial. But I'll be shocked if everything stands after appeal.

This. The legal experts they had on yesterday said that once the numbers are adjusted, the family will get more around $80-120 million. Not chump change at all, but not the full amount as it stands now.
