Clarifying question about masks in VA schools

I’m sure I’m missing something obvious, but doesn’t SB1303 require all VA public schools to follow CDC COVID guidance (therefore, have masking in schools)? So don’t all VA public schools require masking indoors right now, and none of them could make a different choice because of the EO (at least not until it gets sorted out by the courts).

Parents in another part of the state have already filed suit, and the state has responded. It is at the Virginia Supreme Court now.

Okay thanks. But I was reading on Twitter about a list of counties that were going to defy the EO….but don’t they *all* have to defy the EO and continue masking, until it gets sorted out by the courts?

I’m reading that some school boards are deciding to allow parents to use the mask opt out…but aren’t these schools in violation of the state law by doing so?

I’m not a lawyer but I don’t see how it violates anything. The CDC recommends but does not require masks. The CDC recommends other things schools don’t do too.

The CDC also recommends 3 feet distance in addition to masks. No one was trying to sue when the schools didn’t follow that recommendation to get kids back in person.

Anyone thinking of not sending their young kid on Monday?

I'm just thinking ahead for if there are confrontational parents there, I don't want them to see/hear any of that.

Or god forbid, a crazy one does show up with a gun and sends the school in lockdown, you know?

They do this when "practicable". That's what the law requires.

Yes, the CDC recommendations are just that....recommendations. The state law that requires school districts to implement those recommendations to the greatest extent possible is not a recommendation.

The total chaos Youngkin has already created for schools shows what we are in for and, yet again, what happens when a private business person with zero governing experience ends up in an executive government role. His order is also very poorly drafted. Who are the incompetent fools working for him?

The EOs really do seem rushed. He had two months to prepare for this transition, you would think he and his team would have spent more than two hours total on the first-day EOs.
