This is a political witch hunt and it is going to be very hard for Garland to ever be viewed as a-political again. This is banana republic communist type stuff and if you can't see it, you are the people who were fine with things like Chernobyl and pograms and death camps. You are the ones who are so allegiant to your party and not to principles of freedom and democracy.

He was subpoenaed first!!!!
Subpoena Preceded Search Warrant in Push to Retrieve Material From Trump

Uhh. You are so thick. They asked him to put a lock on it. And he did and showed confirmation of the lock. That implies they will tell him what to do with the documents next. And they didn't. And they didn't come back until the raid. I mean, let's assume all the material is classified. If so, H=he SHOULD keep them safe and they should only be transferred to those with an appropriate clearance with appropriate chain of custody. He can't just put the documents in the mail or send them with UPS. SO if it is true that DOJ said "put a lock on them" and he did that, then if they didn't follow up with more instruction and jumped to a raid, this is crazy.

This is daft. The documents were required to be returned pursuant to a valid subpoena, notwithstanding the fact it was illegal to remove them in the first instance. Trump opted to keep classified materials in a non secured faculty for months thereafter. His lawyers could have notified NARA, or better yet NSD, at any time to come collect the documents. They chose not to take steps necessary to protect a national security risk. This comes in the wake of a spate of stories of unauthorized copies of NSA materials being sent to the WH in the last days of the administration by hacks Patel and Cohen-Watnick.

Years ago I worked at a defense contractor. One of our employees took a bunch of classified documents home. When we found out, we immediately reported it to DoD as we were required to do. The FBI was at her house within 24 hours with a warrant. No negotiations, no subpoenas. They just kicked in her door and took the documents back. She also lost her clearance and we fired her. Don't know if she was prosecuted. That's what happens to normal people who do this stuff. Trump got velvet glove treatment.

Yup, I know of similar situation except the person accidentally took an electronic form of documents home. Didn’t matter that it was unintentional. Lost their job, clearance and feds were at their house immediately as well.

They bent over backwards to get trump to return the documents quietly. He brought this on himself.

Garland was smoked out. And personally approved the raid.

Smoked out implies he did something wrong. He didn’t.

How can the slightly more sane of you republicans look at yourselves and say - yup - when the FBI was investigating Hillary’s email, that was correct to do and in fact we are sure she should be locked up for her ‘crimes’.

But a few years later, AFTER 4 YEARS OF A TRUMP PRESIDENCY AND TRUMP APPOINTING THE HEAD OF FBI WHO CONTINUES TO THIS DAY, the FBI is now a corrupt wing of the Democratic Party?

Get ahold of yourselves

Oh, FFS. Did the FBI do a pre-dawn raid to search for those emails that Hillary wiped from her server? For that matter, did they do a pre-dawn, long guns drawn raid to even find the server?
Yes - there are still way too many agents at the FBI who are corrupt to the core. Wray has done nothing to rein in the rogue agents.
This raid was so unwarranted and will come back to bite the Dems in the butt. Mark my words.

It wasn’t pre-dawn. It was at 10 am. And it doesn’t matter because he wasn’t home.

And, NOW you’re afraid of AR-15s? When they’re carried by trained professionals sworn to defend the Constitution? I can’t anymore with you people.

Exactly. He wasn't home. So, why the need for a raid? Why a search warrant when a subpoena would suffice?

It's all for the optics. This WH loves their optics.

Oh yes Trump and his minions are famously responsive to subpoenas.

Everything Rafael touches is done in bad faith. He knew full well that DOJ couldn’t release a sealed warrant absent a court order. Yet he happily serves to role of court jester.

Judge demonstrates minor annoyance DOJ failed to meet and confer with opposing counsel prior to filing its motion. But had it done so it would have ceded the benefit of filing the motion and today’s announcement while Trump dragged his feet. Well played. Trump now has to sh+t or get off the pot by tomorrow.

Key phrase is that DOJ failed to meet with Trump's counsel before seeking the warrant. This was a huge mistake.

No, they failed to meet before filing this motion.

Trump's playing his old game and has started selectively leaking what's on the inventory to his old friend Maggie Haberman.

But the inventory provided to Mr. Trump’s team does reference an array of sensitive material, according to a person with knowledge of the matter. For example, it alludes to miscellaneous confidential documents as well some labeled “top secret.”

Anonymous wrote:The raid was apparently captured in its entirety on security camera video from dozens of angles, despite the FBI demanding the cameras be shut off. And Trump has all that video.

Why would the FBI want the cameras shut off?

That seems very suspicious.

FBI has their own cameras recording. They want security cams shut off so that no one on the outside can watch them searching and collecting. This is SOP.

The occupants of the house are not allowed to be inside during a search. The FBI doesn't want them watching the cams from the outside during the search or videos of their techniques getting out .

IME, each seizing agent has two camera people with them, one for photos and one for video. The seizing agent is the only one who collects the items on the warrant. The other agents look for and find the items, but the seizing agent is the only one who will touch, collect, and catalogue the items. This is to protect the chain of custody. And while the seizing agent is doing so, the cameras are rolling. The agents looking for evidence and items also have cameras on them. Depending on the size of the search, there can be multiple seizing agents, too.

But for those thinking that the FBI agents just rush in and start tossing everything like on TV shows and bagging and tagging everything, it's not like that at all. Searches are very orderly and organized. Every agent has a specific room/area that they're assigned to.

After the search, a detailed list of every item is left with the occupant, though. They'll know right when it's over what was seized by the agents. There's no "we don't know what they took!" outrage possible because if something comes up later at a trial that wasn't on the list of items seized, it can be thrown out.

And since Mar A Lago cameras were also running, we'll soon see.

IF this is a big deal and shows Trump was colluding with Russia (which is what all you LWNJ are saying), then why has it been all nicey nicey for weeks between Trump and DOJ until now. If, on the other hand, this is about returning documents to the national archives, then this is so much overreach that it is in fact the bullying of a potential political rival. Garland said the warrant was necessary because it wasn't possible to any other route. He is saying that this was the ONLY way to move ahead. Garland just put himself into a tiny box.

My interpretation of that this statement is that Trump was asked to cooperate and refused.

But he hasn't refused. In fact, he was cooperating with them.
