Also, she has 2.5% listed towards buyers agent. Is that standard? I recall it being 3% several years ago when we bought. Thanks! |

Teams do this to keep all the business within the team. They will push you to take an offer written by a team member before the house goes on the market. We did this in Virginia and had a nightmare buyer and an agent who kept pushing us to accede to the buyer’s demands on hone inspection repairs.
In hindsight, I would have said no dual agency and that the house has to be on the market for a weekend before an offer is considered. Our neighbors gave time for pre inspections so that they did not have home inspection demands. The agents were absent after the contract and we had to figure out things with the settlement company but they were also affiliated with the team and not helpful. |
| 2.5% only makes sense if the total commission is 5%...which it should be. No one pays 6% in this market, and neither should you. If your agent is seriously asking for 6% but offering buyer only 2.5% then you need to run away and find a new agent. This is seriously shady. |

I thought dual agency is illegal in MD but ok in VA and DC?
Also, for Dual agency, the commission is 4% as most of the gravy is staying with the agent. 2.5% for buyer's agent is pretty standard, no-one pays 3% anymore. RE agents are already overpaid. |
| Don’t. In our case the buyer was an agent from the same company. Our contract said both agents were suppose to be “neutral” but when one is the buyer that’s not possible. |
Individual dual agency is illegal in Maryland, but what should be called “dual brokerage” is allowed with the agreement of all parties. Otherwise if OP didn’t agree and listed with an agent with a giant shop like Long & Foster, no buyers with Long & Foster could make an offer on her house. The team disclosure/ agreement is another layer on top of that. |
