If he is the President of the United States and a state official (or just a prison guard) interferes with him or with the Secret Service, they've committed a federal crime that a Trump DoJ would likely viciously prosecute. The real answer is no one knows what would happen. He would have a good argument that a state imprisoning the President is an unconstitutionally prevents him from fulfilling his duties as President. |
The legal process allows appeals. He won’t be in jail by then. But he’s not going to win so your question is irrelevant. |
I don't want him to wi, but I would not be so confident that he won't. A lot of people thought he had no chance of winning in 2016 and look what happened. |
Most convicts go to prison while their appeals are ongoing. See Navarro. |
The SS has no jurisdiction in the NY state court or penal systems. Most likely Trump would be put in solitary and the SS could send daily details in to monitor the hallway outside his solitary cell. |
The SS can change legal precedents and create jurisdiction if they want to, so I doubt this will deter them. |
Realistic. |
This. But also what PPs said above re appeals. He won’t be incarcerated before the election/potential inauguration. |
The SS is not a legislature or court. They cannot “change legal precedents or create jurisdiction.” |
Peter Navarro says hi from FCI Miami. |
SS is federal. State authorities impeding them is a federal crime. The detail could literally walk into the prison and arrest any guard who tried to stop them and walk out with trump. If he won, there is a 100% chance that would happen |
HE'S NOT GOING TO JAIL. There are no comparables. The few people who did jail time for the same charge had several other charges too, unlike Trump. A first-time offender like him will not be jailed. |
You are clueless. Secret Service can’t break a felon out of state prison. It doesn’t override state law. |
There are federal statutes that require them to protect the president. Interfering with a federal agent carrying out their duties is a federal crime |
Yes, you’re making my point. Navarro was convicted in September and sentenced in January, and didn’t actually have to go to prison until a month ago. Trump hasn’t even been convicted yet. |
