OP, you did everything right. I don't understand why posters are getting on you for the kid kicking the windshield. That doesn't mean the child needs help. I have done things in anger in the past and I'm sure others have too. That is not indicative of the type of person yo are. You are fine. It looks like you we're already thinking about letting her go, so enjoy this time with your kids! Btw, as a nanny, I would never ask to get my job back and say I will give half the payment back given by my employer.
The nanny should never have asked for the second payment as she had no intention of switching out the windshield. She knew it was aftermarket as she didn't take it to the dealer and another company. She should have offered the entire payment back. It would be very hard for a child that young to kick a windshield without prior damage. The child would have to be kicking it with a huge force (and gymnastics is not going to do it as we are in gymnastics too). You'd need a hammer or bat or something else but a common shoe isn't going to do it (and yes, I put my feet up there all the time even though I know better and have never done anything but leave foot prints). Nanny probably broke it driving or someone else and put the kid there to blame her. She knew mom was a sucker and would pay. Windshields if anything usually crack from a very hard flying rock at a strong speed and then splinter depending on the crack. I've had two windshields replaced due to rocks and spidering where there was nothing that could be done (and other cracks repaired) and my husband has had two replaced and several repaired. One of my husband's spidered so badly he could barely see out of it and that was from a rock on a highway that he didn't bother to fix right away. It is not easy just to kick in a windshield, particularly a young child. Personally, I would have asked the glass replacement company if that was even possible before repair. Then I would have had a company come to my house on work hours so it was no inconvenience to her. What ever one our insurance uses comes to the house, is very nice and did a great job very quickly. All we had to do was be home and provide a safe place to work. That is extreme anger to break through safety glass in a car. Also, if the child used that much force, the said child should have been injured and immediately taken to the doctor or ER.
