For a developmentally normal 9 month old, sleeping sitting up would not be a big deal at all. Many get into the seated positions themselves and fall asleep that way on occasion, then later lay down.

The real question here is whether your son's health or developmental issues require him to be in a certain position when sleeping. In that case, your question should be, "my son needs to sleep in a certain position for health reasons, is it a problem that I found him sleeping in a different position at daycare?"

In which case, it depends. If you have communicated the issue to the daycare, then yes, it's a problem. If it's a true danger to your child, then get a note from your doctor so they know it's serious.

The leaky diaper would bother me, and if they sat him in the pack in play instead of laying him down (I think you said in another thread that he can't get into a seated position on his own?) then yes that would bother me.
