Give me a break. Not elective my ass. I have 36 k's and I'm not having elective surgery becuae my back hurts. Yes my back hurts I suck it up because that's the cards life dealt me. I would never even think of doing this to my nf. This is something you do when you are unemployed.[/quote]

So it isn't necessary for you, congrats.  That doesn't mean that it isn't necessary for OP's nanny.  You don't know her situation, you don't know what conversations she had with the doctor, and you don't know whether her insurance is covering it as medically necessary.  Unless you have those pieces of information, how can you make that call?

Regardless of whether the surgery is elective or necessary, normal procedure is to use sick days, PTO and vacation.  Whether you decide to offer paid or unpaid leave beyond that is up to you, OP.  And if you think that she will be out for a while, hiring a new nanny is also valid.  If the surgery is medically necessary and you terminate her, she does have a right to collect unemployment, and I don't think she would be required to look for a new position while she's recuperating.  I would suggest a candid talk with your nanny, see what her thoughts are, and what you budget is, especially because you're probably going to want to hire a temp nanny.[/quote]
