Its a generalization that may or may not be true in each case, and a dangerous assumption for an inexperienced employer. Assuming average rate, not specifying in the contract the actual rates, and realizing your nanny was talking base rate is a recipes for disaster. I know its convenient to believe that this is always true, but its not. I understand OT laws, and I've never been dumb enough to quote this so called average rate. I may quote a weekly rate, but that is different. If I quote an hourly rate I mean base rate and expect time and a half for anything over 40 hours. I've only ever heard MBs on this board saying its always average rate. Wtf is an average rate? There's your rate and then legally mandated OT pay. You all made this crap up.
