Stop saying this! Its a generalization that may or may not be true in each case, and a dangerous assumption for an inexperienced employer. Assuming average rate, not specifying in the contract the actual rates, and realizing your nanny was talking base rate is a recipes for disaster. I know its convenient to believe that this is always true, but its not. I understand OT laws, and I've never been dumb enough to quote this so called average rate. I may quote a weekly rate, but that is different. If I quote an hourly rate I mean base rate and expect time and a half for anything over 40 hours. I've only ever heard MBs on this board saying its always average rate. Wtf is an average rate? There's your rate and then legally mandated OT pay. You all made this crap up.

It's just one poster with her crap. She wants to make her not-so-bright nanny feel like she's getting a higher rate. See how devious she is?

As long as the calculations are understood by both parties and are spelled out in the contract, it's all good.

That's just it. The PP I responded to is constantly giving advice to inexperienced employers that not only should you speak in terms of gross wages, but also "average" wages. Its a dangerous generalization. Across all industries wages are discussed in gross terms, this is understood. There is no such thing as average wages in any other industry, so to advise someone to negotiate in these terms without specifying the need to clarify actual rates is misleading and bad advice in my opinion. Many nannies speak in terms of weekly rates, they do not speak in terms of average wages. If she quotes an hourly wage, that's precisely what she means.

$15-$20 an hour gross average not base rate. You do need to document the actual base and OT rate and if you go over the original schedule you pay the higher OT rate.

If you do it this way, just make it very clear in the contract so the nanny understands the breakdown.

Quoted hourly rates are always gross, or should be.

Let's not get silly here. If your rate is 25/hr, it's 25/hr. The legal requirement is to pay time and a half beyond 40 hours. Period.

No. $16-20 is gross pay; before taxes.
Keep in mind that pay is time and a half for any hours worked past 40.

A neighbor and I are starting our search for a nanny for our two children, ten months and four months. I keep seeing that $16 - $20 a hour is the salary range for this area, but I just want to clarify - is this the take home pay, after social security and Medicare taxes?
