Our AP got her visa and will be staying with us for 6 months after her program is done. I'm trying to figure out a fair payment moving forward. has anyone kept their AP and can let me know what they did about payment? |
This isn’t the exemption and she’s still an AP during that time? |
The AP can't provide paid childcare during this time |
What type of Visa was she issued. This seems like an under the table type arrangement. If so perhaps current rate plus half of what you’d give the agency as the program fee. |
Sounds illegal. |
what visa did she get? tourist? student? either one, she cannot work. it is illegal |
One of our Au Pairs stayed on a student visa for a year and did some childcare for us in exchange for room and board (but it was only about 10 hours of care per week since she was a full time student). If we ever had her do a date night or something we'd pay her our normal babysitter rate. I guess this is technically illegal but for so little cash and work exchanged I didn't worry about it. |
Did you pay for her school, attorney fees ? Just curious, we are dealing with the possibility of doing this now. I’m done with the au pair program but want to help this girl and do what’s right for her but also don’t want to be responsible for her forever. |
Doing what is right for her is not allowing her to be illegal. |
How is having her on a student visa illegal? |
She can get a student visa and study, but not work/provide childcare to you in exchange for your support. |
Agree it is illegal, but low risk of getting caught. However, if you are caught there are probably some not good tax implications for you and immigration impacts for her. |
We are in a similar situation.. not really by choice.. as our AP is waiting on her visa to arrive.
And yes I do understand this is technically 'illegal' but I'm willing to take the risk. The alternative is for her to go home to a country that has no jobs because she can't afford an apartment. I am continuing to pay her what I was paying her ($1000/ month) and still covering all room and board. I would pay more but our expenses had gone up as we have already committed to private school. If her hours and workload was remaining the same I would at least double her pay. |
