Possible MB appalled I asked for OT rate. RSS feed

I live in Los Angeles and the schedule i was asked to work was MWF from 7 am to 1 pm and Tu/Th 7 am to 7 pm. She seemed shocked when I named my rate and said that any hours after 8 hours a day would become overtime (to be paid at $30/h). I used to work from 8 am to 5 pm as a nanny with no breaks and I never asked for OT. I’m hindsight I regret not asking since any job I’ve had has always paid me time a half after 8 hours. As far as I’m concerned that’s the law here in CA. Someone please correct me if I’m wrong.

Using google, I discovered in CA it’s actually hours over 9 for nannies, not 8.

Sounds like this job is not a fit.

Yep anything over 40 is OT.

In California anything over 9 hours in one day demands overtime. That this potential employer is “appalled” by that is a giant red flag. Overtime cannot be waved by an employer or an employee. It’s the law.

Run, OP, don’t walk away from this creep.

Op here they said and I quote “that’s out of our budget” “no overtime those days”
Maybe they justify it because it’s only 39 hours total all week. I obviously didn’t take the position as they can’t afford a nanny.

Doesn’t matter if it’s out of her budget. Overtime is guaranteed after nine hours in a day. Period.

If that’s not in their budget, they need to structure the job for 3 9 hour days (and never be late) with 2 6 hour days or just do 8 everyday.

Of course it doesn’t but if you can’t afford a Maserati you buy a Honda. You do not get huffy with the Maserati dealer and expect to get the car because the increase wasn’t in your budget.

That parent is acting illegally in hiring a nanny but denying overtime. It is against the law.

I’m in LA, any job I’ve worked after 8 hours I get paid 1.5x more than my regular rate

In California we also have OT over nine hours in one day. OP is in California and would definitely get overtime.

No, it’s a good thing she asked for overtime. Just remember if you get fired a few weeks later, that it’s the MB’s prerogative to get a Honda instead. You can’t make the MB buy a Maserati if she doesn’t want one.

I'm getting 42 hours when I do the math...
6 hours on MWF=18 hours
plus 12 hours each on T/TH=24 hours

18+24 =42

Right?
