Yes but I’m in CA and I have always been paid OT after 8 hours for as long as I’ve been working. I worked a nanny job before where I was never paid an OT rate and I regret never doing anything about it. |
Except in California (and some other states) where overtime is after 9 hours in a day. OP is guaranteed 6 hours of overtime for those two 12 hour days rather than just two in cumulative hours per week. |

That's not even a lot of money. My cousin is a nanny in San Diego and she makes $30 per hour for 3 kids, which I think is a bargain. Her employers know the law and do not go over 9 hours -- that would be some nice overtime bucks! She works 7-3 each day. Mom and dad switch off coming home a bit early from work. |
overtime yes absolutely, after 9 hr a day. I would not take a job with 12 hr day for any overtime pay, it's too exhausting, and you are supposed to be paid overtime if you agree to work 12 hrs a day. |
I am more than happy to pay overtime. But we re-negotiate the base pay.
Perhaps I hired you thinking the overtime would be 1 hour here and there but needs change. When needs change, fair to ask for over time but contracts can be renegotiated any time. If I’m paying 20 per hour and I have to pay 30 an hour now for some hours, maybe I want to change the base rate to $15. A lot of people who pay overtime do it that way. It’s a completely legal way to do it. I wouldn’t get too excited about getting overtime for those nannies thinking about asking. Sure you should be paid but remember MB have an hourly rate too and salaried workers don’t make anything over 40, not even base pay, never mind overtime. If MB makes 35 after tax, she’s not going to pay you 30 to watch your child. If she makes nothing for working extra, she’s not going to pay you 500 dollars and extra per week for all the overtime you put in all of a sudden. She can’t afford to. |
It’s not up to the nanny, PP. Overtime is the law. Change base pay if you can’t afford it but you haven’t the option to deny it. |
+1. Nannies don’t “ask” for overtime. Employers either pay legally or illegally. Stop trying to make this a nanny-issue! |
