Our nanny was terminated for just cause and she had left our house before we could ask for her to return our property.

I had asked for her to return our belongings, and she said she would on Monday. It’s now Wednesday and I’ve called and texted - no response.

She has a house key and car seat. I’m guessing it’s time to replace the car seat and change the locks. I don’t think she would retaliate, but it was in our contract that she return all belongings at conclusion of her employment.

I have no interest in filing any kind of claim. I’m just annoyed.

You terminated her. Just change the locks and get a new car seat. Not a big deal. If she returns it it is a good spare.

I cant imagine trying to get an item back from someone I fired. Definitely just move on.

Bad advice here.
This would just make a bad situation 100% worse.

I would call a locksmith to change the locks.
As for the car seat, I would just purchase another one.

It is likely for the best that everyone moves on from this.

I'm not bringing back a car seat to someone who fires me. Come on. Time to go to Target and invest $100 in a new one.

Some carseats are $400. I would want mine back personally.
I know im oging against everyone else but I would want to seat back. What did you fire her for?

If money is still owed, I'd pay her minus the cost of the replacement carseat and locksmith visit. I'd give her 3 days to produce the items or else she pays the replacements.

You cannot withhold money from paycheck except for taxes unless agreed to on writing by payee. Try it and find yourself in court responsible for court costs plus interest on money withheld.

You should have gotten these thing back at the time of firing. Your fault.

So we purchased a new car seat specifically for the nanny. Which obviously I will not do again. It was a $280 loss. To change the locks it’s going to cost around $200.

And no, I would not withhold her pay. I’m just annoyed. I put it in our contract that she would return our belongings and she agreed to it in writing. I guess I was hoping she would honor the contract.

You don't need a $280 or $200 car seat. You can get one for 1/2 that price.

A $100 car seat is just fine. Or get a used one from a friend who’s kid outgrew it.

How do you pay her? Can you do it by check and tell her she needs to pick it up. Ask her to bring the items when she comes.

Absolutely agree with PP. Last check should be in exchange for all of your property. However, I’d suggest changing the locks, even if she gives you the keys.
