We are about o hire out first nanny. She is set to start at the beginning of next month. We REALLY like her. After interviewing several candidates, L just really stood out from the rest. She engaged with our son. She has credentials and experience to back up her vocation. I could not wait for her to start. Unfortunately, while we wait she was getting screened through the agency and we received an email saying that her drug screen tested positive for marijuana.
Supposedly she was over at a friend’s house who cooks with CBD oil and that’s how the traces of the drug got into her system.
This sounds like a stretch to me. Anyways, I am not sure how to proceed. My husband said we should still hire her, BUT since she would be driving our child around, I don’t want her judgment to be impaired.

What would you do if you were in my position ? I was beyond excited to have her start. There was a genuine love and compassion in her that I knew would make her an amazing nanny. At the same time recent studies show that marijuana can impair one’s judgment. I don’t know how much of it she uses

We have friends who use recreationally and have their life together BUT they are childless and I’d never let them babysit my child. So, while I don’t care that they smoke, if someone *is* watching my child, then I do care.


The stipulation we are thinking of doing is having her test again in about two weeks and re-test for a drug screen a random after she starts-within 30 days of starting. . But I am not sure if we should do this either. —this would be in her contract, so it’s not like we’d surprise her with it.
The agency will email her informing her of our stipulation to see if she is willing to do it.

Lets assume she does it in her spare time. Why would you assume she would do it while working? If you found out she drinks sometimes would you not hire her because she might get drunk at work? I yhink if you got s good vibe from her go ahead and hire her. But dont show her you distrust her by doing a random drug test

Yeah you seem nuts and neurotic. She is also an idiot to use before a drug test. Do you drink? Even done an edible? Guess what, plenty of people do this on their free time, including nannies.

Plenty of employers require no drugs on and off duty. My contracts always read that I will submit to any drug or alcohol testing prior to or during employment, with the stipulation that testing is in a licensed facility (no at-home tests). While it may be legal in some states, marijuana is still illegal at a federal level, and until it is legal federally, I don’t see why any nanny would have an issue with this.

You cannot control what someone does outside of work. I don’t see why any nanny would want to be controlled this way. I can just imagine the day to day working for that type of family.

I would continue looking for a Nanny who is 100% drug-free.

Sure - it is legal in certain states, but you don’t want anyone driving your child around who smokes pot on her off time.

Please explain how smoking pot at night in your home is different than a glass of wine.
Surely don't want those wine drinkers driving kids around!

I wouldn’t do it. Pot smokers are losers. Now that it’s legal in California, every single day I see and smell pot coming from the windows of cars. Literally every day!!! Marijuana is a deal breaker for me.

You cannot control what someone does outside of work. I don’t see why any nanny would want to be controlled this way. I can just imagine the day to day working for that type of family.


I hate it when nannies misstate what people in corporate jobs face. YES employers can “control” what you do outside of work by requiring you to pass background checks.

I personally don’t care if my nanny uses cannabis products but it’s just not true that employers can’t make demands like that.

I hate it when people don’t know the difference between a background check and a drug test. And no, your employer cannot control what you do. They can request you don’t do drugs and inform you that they may have drug testing. However, it depends on the state laws and circumstances.

I concur.

People who smoke weed are truly losers & I wouldn’t want my child in the company of a common loser.
I would continue my Nanny search.

I don’t want to work for anyone who uses marijuana (or other drugs!), so it works for me!
