Nanny here.... I'm going to start a new position in a few weeks (nanny share) and the families are going to pay a hourly rate.... I'll work 45 hours a week and when I asked if they're going to paid overtime (5 hours over time each week) they avoid to answer... my question is they have to pay overtime after 40 hours right? I never have to this issue with any family I worked before... TIA

Don't ask, tell. Give them an invoice with the law stapled to it.

It's the Fair Labor Standards Act (FLSA) to be specific. It applies to nannies and other domestic employees. The law says you must be paid time and half for hours worked over 40.

In my opinion, if they are not addressing your concerns up front, then this is a MAJOR red flag things won't get any better.

Either they agree to OT at time and a half, or you walk away.

Live-in or out? If live-in, in MD, NY or another state which requires OT for live-in domestic help? If you're live-out or live-in in a state which requires it, yes, they have to pay OT. If not, then no, they don't have to pay it.
