I've been reading up on the new mont co sick leave requirement, that requires 1 hour paid sick leave for every 30 hours a nanny or other sm bus employee works. So I've calculated that my 20 her a week nanny gets 32 hours of paid sick leave (and additional unpaid sick if she needs it).

Is there a similar requirement for paid vacation leave? I couldn't find any info. In addition to the paid sick leave we give all federal holidays paid and any days that we are out of town (because she is part time our contract allows us to pay only for hours worked, but but we thinks it's fair to pay her for hours she is able to work, unless we both agree with advance notice.)

No. That is why the sick leave law was put into effect. There was no requirement to give anyone any paid time off, and now there is only the requirement for sick leave.

If you read the law, any leave you already give that can count for sick leave can be used to fulfill the requirements of the law.

I give my nanny 12 days of paid time off to be used at her discretion for whatever -- sick, vacation, etc. -- she also has guaranteed hours, so by eliminating the "my choice" week, she ends up with more PTO altogether, and I don't track vacation vs. sick.

Yes, we also revised our leave so that it's 12 paid leave days annually - to be used for anything (sick, vacation, personal, etc...) so we are in clear, full compliance with the new law.

Technically to be in compliance with the law, as I read it, you need to provide up to 32 hours of paid leave and an additional 24 unpaid. So you're going above and beyond - if your nanny is 8 hours/day, you're giving the full amount of required leave (7 days) as paid, and an additional 5 days on top of that. Does that include federal holidays, or do you give those as well?

I'm the pp above who did something similar w/ 12 days of annual leave for any type of use. Yes, it's more than the law requires, but it's actually less total than we used to offer when we broke out vacation and sick leave. Federal days off are an additional ten days.

Just to confirm - if I have a 6 hour per week babysitter, she has 1 hour of paid sick leave accrued every 5 weeks?

Yes, 10 hours (roughly) per year. If you didnt use her services on a regular basis and didn't file taxes because you were under the threshold, you could be exempt.
