I use a dependent care FSA through my employer for my nanny expenses. I know I can only use that money for her salary if I'm working or looking for work. Very rarely, I'll take some time off work to do errands, doctors appointments, etc: i.e., she's watching the kids and I'm not working. I always mark down those hours and don't use FSA for it. My husband says I'm splitting hairs and that no one actually does that. So, I'm asking. Does anyone else follow the law this closely?

I use the dependent FSA for covering our nanny salary costs (to the 5k maximum).

Our costs for the nanny so infinitely exceed 5k annually that I've never thought about it. I submit for reimbursement once a year.

Are you working so little that this is even an issue? It seems unnecessary to have to focus on it to this extent.

The FSA childcare account can only be used for $5k, so I've definitely maxed out that benefit just be using the normal work hours.

I've been doing it monthly....I do max it out, but maybe I'll start doing it annually to avoid this!

Same here. It's gone so fast.
