I thought you have to get a license to do any paid care of an unrelated child in a home where the child doesn't live.

Child day centers are child day programs offered to (i) two or more children under the age of 13 years in a facility that is not the residence of the provider or of any of the children in care or (ii) 13 or more children at any location. A child day program is a regularly operating service arrangement for children where, during the absence of a parent or guardian, a person or organization has agreed to assume responsibility for the supervision, protection and well-being of a child under the age of 13 years for less than a 24-hour period.


No, nanny shares are not illegal. Especially if there are only two children in the share. But if you read above, even if there ARE two or more children, as long as they are in the nanny's home or the home of one of the children, it isn't a child care center.

If you provide paid care for a child outside of the child's own home (out of someone else's home), you are required to abide by the requirements of an in home daycare provider. These regulations are separate and different from "center" regulations.

The laws for these providers are much more burdensome in Maryland than in Virginia. Anyone know about DC laws?

what about the minimum wage law, when you're doing a nanny share? MoCo is 12.50. So you can't have either family paying less than that?
