Risks in Employing an Illegal Immigrant As Many RSS feed

Hi,

We have a 4-month-old infant and have been interviewing a number of nannies to take care of the baby full-time. Recently we found a very good match and she just started working for us a few days ago. Unfortunately we also just found out that she's actually not legal to work in the United States.

What should we do now? She is fantastic and we would like to continue hiring her but don't want to take the risk of doing something illegal.

Can somebody please advise what is the risk associated in employing somebody illegal? She does have a tax ID

She is illegal, how would she have a tax id? So you hired her, never did a background check or gave her a w2? You sound like very responsible parents....

So the risk if found out are fines, loss of job depending if you work for a government agency and possible jail time. So your risking a lot. The only thing that will happen will be deportation if they find her. There are plenty of great legal nannies willing to work on the books, hire one of them.

It is possible to get a tax ID without being legal.

My child is also 4 months and he's very important in my eyes and deserves a LEGAL childcare provider. I would never higher an illegal and if I found out she was one, she would be fired immediately.

Most illegals aren't evil but like I said, my child is worth it and I will only get the best and that includes a LEGAL childcare provider.

I agree 100% --- I'm the PP who just wrote a comment. I don't understand how a parent can put their baby in the care of a ILLEGAL. I'm sure she is nice or else she wouldn't have hired her but she's still an illegal citizen and to top it off, she could kidnapped OP's kid and authorities would have a harder time locating her.

OP I'm sure your child is worth a little extra for a professional, law abiding nanny.

To respond to the real question, and not other peoples fear/hate of 'illegals', unless you want to run for president or think you may be tapped for Sec. of State one day, it is really not that huge of the deal. The nanny we are lining up is 'legal' but honestly, it was not a deal breaker for me.
Many people hire 'legal' and then pay under the table. It is all a gray area. The one I feel for is your nanny- who likely has to take less wages and harder working conditions because her employers know they can walk all over her.

Slavery lives on, but without the whipping. Not between the white man and the black man. It's now between the rich white woman and the poor immigrant nanny, who is forced (that's the only thing she can do, with her broken English) to the raise the white kids as she's ordered, and keep the floors polished. And she's not even "allowed" to bring in her own child, for fear that the white child would be contaminated with the wrong genes of the lower class.

My family came here as refugees from Cuba and i have friends that are illegal, but when it comes to childcare I wouldn't trust anyone especially one that I could not get a valid background check on. And to the pp who said unless your president it doesn't matter is misinformed, if you hire someone illegally and own your own business or work for the government you are committing fraud/tax invasion. You will be subject to fines, penalties and job loss.

she could file ITINS and receive a tax id number, but that doesn't make her legal or what your doing any less illegal.

You're a joke if you think actual slavery is the equivalent of being in a country illegally AND working for pay without being able to bring your kid. Get over yourself.
