This is my opinion on why the husband filed the lawsuit:
Once upon a time an affair between a separated spouse and a faculty or staff member at their child's school -- no matter how genuine and beautiful the love, or how very discretely and privately maintained -- would have been considered a shocking thing indeed.
And in that time, if anyone had caught a whiff of what was going on, there would probably have been some societal consternation and condemnation of such love.
For better or for worse, those days are gone. People now take a live-and-let-live approach and are, frankly, more likely to laugh at an affair than to judge it.
It is likely that no one at all has changed either their opinion or their treatment of the separated spouse or the staff member involved.
Perhaps the husband, recalling that once-upon-a-time, is frustrated that no one now seems to care about behavior which is arguably hurtful to him.
In filing the lawsuit he may hope that society-at-large will provide the judgment of the relationship that the immediate community involved did not.

Suppose the "common knowledge" alluded to above is provable. Suppose (though it is not substantiated by the complaint, in stark contrast to the lurid details of the affair) that the playdates carried a mixed "therapeutic" purpose in the sense that J.H. offered his insights to the mother about the patient during those playdates. Suppose he was not paid for those insights. Finally, suppose also that J.H. referred the child to another professional upon first realizing his attraction to the mother. Would T.N.'s suit have less merit? In other words, is it possible to _ever_ terminate the patient relationship for the pursuit of love/lust/adult attraction/whatever-you-want-to-call-it with a relative? Mental health professionals (with knowledge of governing ethical codes) please step in to comment . . .
