Were you there to see the condition of her body?  Who are you to say it was probably not necessary?  I think the bruising and scrapes and abrasions and general mess of her body was probably enough to warrant a rape kit, as determined by medical personnel.  Why would she not have a rape kit done in this situation?[/quote]

A woman can decide whether to use a rape kit or not. With no memory of the night, she would have a hard time determining whether she would want to undergo such an invasive ordeal or not. Either way, the rape kit ordeal is a part of the legal process, and does not factor into the sentence.[/quote]
