The other piece of important information will be when other straphangers alerted Penny to Neely's physical distress and how long Penny maintained the chokehold after being alerted by others. My understanding is that Penny continued to hold for multiple minutes after being alerted. The jury will see a LOT of evidence that hasn't been released publicly. Probably dozens of witnesses who don't want to go public in the media. Tons of people with unreleased video on their phone. Likely videos of Neely earlier in the day, as part of an attempt to explain his mental state. MTA security videos. A reconstruction of Neely's last 24 hours. [/quote]
