NP: it will be a critical piece of information when determining the verdict. The other piece of important information will be when other straphangers alerted Penny to Neely's physical distress and how long Penny maintained the chokehold after being alerted by others. My understanding is that Penny continued to hold for multiple minutes after being alerted.

The jury will see a LOT of evidence that hasn't been released publicly. Probably dozens of witnesses who don't want to go public in the media. Tons of people with unreleased video on their phone. Likely videos of Neely earlier in the day, as part of an attempt to explain his mental state. MTA security videos. A reconstruction of Neely's last 24 hours.

I am split on what he did - that means I do not support his actions. It’s the opposite of split, it’s the only cohesive way to see this for me. Jordan Neely should still be alive. I also do not believe Daniel Penny intended to kill him. I also do not believe it’s innately protective of white supremacy to want to take the g.d. Metro or subway without having a rational fear of being accosted and attacked. That last part is something that is not in my view adequately captured by either statistics or anecdotes: I first started taking the subway in the very early 90s, pre-Giuliani, when crime was higher. However, running into deeply unstable individuals was far, far rarer - group bad acts related to gang and similar activity spurred a lot of crime then.

Now, however, we’ve had the time to see the impact of the hollowing out of social services, the raising of requirements on what it takes to involuntarily commit someone, and what happens when street pharma gets more and more dangerous (meth, fent, laced marijuana). From what I understand, many addicts we may see cannot in any meaningful way ‘get better.’ The neural pathways are just destroyed. So absent that, we’ve got to think of involuntary commitment that’s actually humane and doesn’t future degrade people, and there’s no push for that. Maybe this will lead to some kind of granular activism for that. I don’t know.

Or, more accurately, non-extremists are afraid to share their views, making it seem as though the voices of the extremes on both sides have more support than they really do. I'll also add that the loudest voices care little for truth, nuanced understanding, or anything other than amplifying their own performative platform. That goes for left and right.
