The PPs that keep using the word "illegal" seem to think it means "criminal" when it comes to immigration status. In fact, it's a civil matter, not a criminal one. Here are the facts: *Entering the U.S. without inspection (e.g., crossing the border without a visa or going through a port of entry) is a violation of immigration law—but it’s not a criminal offense in most cases. It’s a civil violation, similar to overstaying a visa. *Overstaying a visa (which is how a large number of undocumented immigrants become undocumented) is also a civil infraction, not a criminal one. So, while being in the country without proper documentation is a violation of immigration law, it’s not the same as committing a crime like theft or assault. And importantly, seeking asylum—even without a visa—is legal under both U.S. and international law. In short: 👉 Being in the U.S. without a valid visa is a legal issue, but it’s not necessarily a criminal one. 👉 The term “illegal” is not a legal classification and is discouraged by many legal and human rights organizations.[/quote]
