No pregnant woman is required to certify their pregnancy with VDOT.    For HOV purposes, there must be proof of existence for all passengers.  The "already born" have that proof because you can see their physical being.   The unborn, since you can not see their physical being, require a different form of proof.

Any woman who does not use HOV lanes has no need to certify their pregnancy.  Pregnant women who use the HOV lanes, but already have the required number of passengers, without counting their unborn child, also have no need to certify their pregnancy.  [/quote]

I have no problem with this.  Have you seen some of the things people try to pull to avoid being caught in the HOV lanes?  Blow up dolls, mannequins, etc....

I would not put it past some women to stuff a pillow up their shirt and claim pregnancy.  If you want to drive in the HOV lane alone as a pregnant woman, then some kind of proof is needed that you are pregnant so that some activist doesn't try to file charges against an officer who pulls her over and asks for proof. The Department shall establish a process whereby any pregnant woman who is the registered user of a toll collection device can certify to the Department that she is pregnant and flag such toll collection device as being used by a pregnant woman. The Department shall coordinate with all operators of photo-enforcement systems and establish a process to recognize any such woman as two people for determining occupancy in high-occupancy vehicle lanes and HOT lanes. Such woman shall not be issued any citation or required to refute a citation issued via a photo-enforcement system, provided that she has properly registered with the Department pursuant to this subsection.

Do all HOV lanes even have toll collection devices? I thought that was only EXPRESS lanes. Also, what happens after I get certified as being pregnant and then miscarry? How will they know? Seems like the proposed system is set up for cheating and unduly complicated and intrusive to boot. I wonder if I can take my frozen embryos from the fertility doctor with me and count that as a person. Hmmm...[/quote]
