PP here,
Sigh, you must be a DC resident. You can prove this by showing a paystub. But your body needs to reside in DC, whether you rent, own, pay property taxes, income taxes, qualify for services, etc. Your body and the child's body need to keep themselves and their stuff in DC. Why is this so hard?
Actually, I asked a lawyer about this for a situation that never came to pass, and he said that: [Pain Legal opinion] as long as you "Maintain a Residence" in DC, you qualify. you can keep an apt that you never use in the farthest reaches of DC and stay in a mansion in Mclean, and you can claim dc residency. [/Paid Legal Opinion] [My Opinion] Ultimately, DC taxes are what pay for the school, so if the person has a paycheck in DC, they are paying for the school. If they own a home in DC and don't claim homestead, they are actually paying more taxes, so I wouldn't even say that homeownership is the defining quality. [/My Opinion] I don't have a dog in this fight, but I do find the pettiness amusing.
I think it is safe to say that most of the residency fraud in DC is not being committed by people who are paying DC income tax but residing in another state.
