Actually, I asked a lawyer about this for a situation that never came to pass, and he said that: [Pain Legal opinion] as long as you "Maintain a Residence" in DC, you qualify.

you can keep an apt that you never use in the farthest reaches of DC and stay in a mansion in Mclean, and you can claim dc residency. [/Paid Legal Opinion]

[My Opinion] Ultimately, DC taxes are what pay for the school, so if the person has a paycheck in DC, they are paying for the school. If they own a home in DC and don't claim homestead, they are actually paying more taxes, so I wouldn't even say that homeownership is the defining quality.
