This. My ex-SIL tried to do this to my brother. He didn't want a divorce, but we urged him to get a lawyer and he filed first to keep them in state.

I didn’t say that. If he moves (which OP said he planned to do!) and files, the divorce will occur in that state.

That divorce would be dismissed since the court wouldn't have in.oersonam jurisdictiion over the OP unless she has minimum contacts with the forum per International Shoe.  If he tries to asset jurisdiction due to his having the kids for a few weeks that will fail as well since the kids permanent residence is the marital home that the mom lives in. He will have his case dismissed and be hit with big time sanctions and attorneys fees for attempting to defraud the court.  Courts live to dismiss these kind of cases because they don't want to deal with another states stupid custody disputes.  Alternatively his judge will order him to refile in the correct jurisdiction.
