This is potentially a bad precedent. It will have to go through the courts. The mitigating factor is advocating for Hamas - an officially designated terrorist organization. Yes, we have free speech. But foreign citizens - even Green Card holders - advocating for violent religious extremists like Hamas becomes a national security concern. Hamas is well known for suicide bombings, blowing up buses and restaurants, torture, slavery, kidnappings and so on. Green Card holders seeking to increase the influence of Hamas in America - and college campuses in particular - is definitely pushing some legal boundaries.
If what you have said is true, then the chances are is that he will be deported. For those of you that think deporting him is harsh, when you apply to come to the US, you are asked questions about terrorism etc. I bet he never put on his application that he supported Hamas or any other terrorist organization. If he had, he wouldn't have been allowed into the US in the first place.
But did he support Hamas? Is he quoted anywhere saying anything other than protesting the war against the Palestinian civilians in Gaza? There are many people who protest for the Palestinian civilians who do NOT support Hamas. Calling protesters supporters of Hamas is a tactic used by the GOP/MAGA and the Israeli government to malign people who are exercising their right to protest bombing of innocent civilians.
So I think that will be the key point. Hamas is a designated terrorist organization. It is responsible for suicide bombings, kidnappings, torture, and murder. It is deeply misogynistic. It advocates for the death of all members of the LGTBQ community. It is profoundly anti-democratic. It has advocated for the genocide of all Jews. It is also absurdly corrupt. Its leaders were billionaires that stole billions in aid. And Hamas has shown that it is perfectly capable and willing to murder more than a 1000 innocent people on a Saturday morning. The Columbia student protestors have shown over and over again that they are advocates for Hamas. Just listen to them - "We are all Hamas." "Hamas, we love you. We love your rockets too." And on and on. There are a million different ways to protest against the Netanyahu government. Israelis do it every day. But the student protesters have chosen to affiliate themselves and to mouth the propaganda of Hamas - an officially designated terrorist organization. For an immigrant, it would be like obtaining a visa for Ireland and then advocating for the death of all Catholics, gays, and the subjugation of women. It would be a problem anywhere. This is not a free speech issue. This is knowingly advancing the interests of terrorists while in the US. Regardless of the nuances of the law, it really is profoundly stupid for immigrants to loudly advocate and encourage a terrorist organization. He should probably be deported just for the lack of common sense and decency alone.
