As I read it, ex had 50% of weekends but didn't have 50% overall custody because he didn't want to committ to regular weekdays; instead he proposed to get more custody by taking more than 50% of weekend time. Personally, I doubt a judge will order that. However, Ex can waste a lot of money trying, and it is unclear if it will be the OP's money he wastes as well since she has asked for costs. IMO, it's worth paying some money to preserve a 50/50 sit on weekend down time, which is so critical to the health of the family.[/quote]
