[/quote] The state trial is the practice round. The feds get to see what they try as a defense strategy. But, while I know a few posters here have hard-ons for jury nullification, I'm sure his lawyer will tell him it isn't going to work. She's ethically bound to. He and his lawyer have an incentive to play things out at this stage. They get publicly, and if there was some sort of magical mistake, maybe they'll toss out some evidence that will change the situation. But in all likelihood, once the judge rules the evidence is admissible, he'll take a plea deal to get the death penalty off the table. He'll have to accept life without parole because I can't imagine the feds would accept anything less. The federal case is super clear. But, in 10-15 years, the family could seek clemency. Would he get it? Hard to say. He'd have to renounce his actions, which I'm not sure he'd be willing to do. But 15 years in prison can provide some perspective.[/quote]
