The state trial is the practice round. The feds get to see what they try as a defense strategy.

But, while I know a few posters here have hard-ons for jury nullification, I'm sure his lawyer will tell him it isn't going to work. She's ethically bound to. He and his lawyer have an incentive to play things out at this stage. They get publicly, and if there was some sort of magical mistake, maybe they'll toss out some evidence that will change the situation. But in all likelihood, once the judge rules the evidence is admissible, he'll take a plea deal to get the death penalty off the table.

He'll have to accept life without parole because I can't imagine the feds would accept anything less. The federal case is super clear. But, in 10-15 years, the family could seek clemency.

Would he get it? Hard to say. He'd have to renounce his actions, which I'm not sure he'd be willing to do. But 15 years in prison can provide some perspective.

Agree. Fed trial should go first and wrap it all up, saves time and money too. Then Luigi can finally start his mental health therapy.

I think nullification by one or two is possible, but unlikely. But then they'll just retry.

Don't forget that they'll exclude jurors that have an axe to grind. Also, I think jurors intent on nullification will have a hard time keeping their mouths shut. If they talk about it, there's a good chance it will make its way back to the judge. If the trial is still going on, the judge would probably quickly replace them. If it's during deliberations, the judge might still replace them if the statement was blatant enough and corroborated by multiple people.

I think the odds of an acquittal are effectively nil. Assuming the key evidence doesn't get thrown out, and I can't imagine it will, they have an incredibly strong case.

And since there's a state case and a federal case, they've got plenty of chances to get the conviction.
