If a person has no badge or ID, they are not an official agent of anything. He has no more authority than an off duty police officer in that scenario.
Do you really believe off duty police officers have no authority to effect an arrest? This highlights the knowledge gap that causes so much confusion.
But if you don’t identity yourself and prove it why would I not assume that you are a bad guy and use my own CCW?
The alderman was asking for a judicial warrant. They seemed to know those men were ICE. If you’re being detained or arrested you too will know who you are dealing with. If you choose to draw your concealed handgun the very best outcome would be the revocation of your CCW. The worst case scenario is death. “Kidnapping” can be a grey area for the use of deadly force, especially in areas that aren’t gun friendly.
What’s the saying, judged by 12 over carries by 6? Anyway, it’s going to happen. I think it’s the administration’s goal. There’s really no other reason for the escalating behavior by the ICE “agents.” MAGAs will pretend to be suprised and outraged, normal people saw it coming miles away.
As a lawyer who practices criminal law and the wife of a LEO, I agree that the way these arrests are happening is unnecessarily dangerous for the agents and officers involved. I also think that internet "activists" have done everyone a disservice by encouraging people with no understanding of law enforcement to inject themselves into arrests and demand to see a judicial warrant. By all means, educate people about what officers can and can't do without a warrant signed by a judge, but these confrontations are ineffective and dangerous.
