[/quote] DP. I don’t think OPs thought was suing them. But when she realized she is injured she wanted them to cover cost. That doesn’t mean needing to sue- it just means your insurance contacts theirs and they work it out. Assuming this is a minor injury, the other insurance would pay the ER bill and maybe a follow up. Which is appropriate for an accident that is your fault. Now if OP starts saying she needs months of therapy and is disabled, etc. then yeah, the insurance will likely push back on continuing to pay out and she’d need to sue. [/quote]
