Yup. I take my DD to a sport at a place with a similar setup. All the signs in the world didn’t prevent metal water bottles and phones from being dropped from the 2nd floor railing onto people’s heads. They eventually had to specially machine a sheet metal screen to attach to the railing to prevent things from falling through. And people still manage to drop things over the edge!
What place is this, I would avoid it for sure!

Accidents happen in life, OP. This was an accident.
And that is what insurance is for. Whoever is at fault for the accident is legally liable for the expenses. Their insurance can pay.

Likely the family who did this doesn’t have insurance to cover a claim and wouldn’t be responsible unless you could prove negligence anyway.
My friend was plowed into by a snowboarder. She received 250k from his insurance policy, which was held by his parents. She did not sue.

A 6 year old accidentally broke my arm. Was out of work for weeks because I can't do my job with a cast. It never even occurred to me to try to get the other family to pay. And my insurance did not go after the facility where it happened or try to get info about the other family. Was the kid doing something they weren't supposed to and was the mom not supervising them correctly? Yes. Did it make a difference to me? No.

DP. I don’t think OPs thought was suing them. But when she realized she is injured she wanted them to cover cost. That doesn’t mean needing to sue- it just means your insurance contacts theirs and they work it out. Assuming this is a minor injury, the other insurance would pay the ER bill and maybe a follow up. Which is appropriate for an accident that is your fault. Now if OP starts saying she needs months of therapy and is disabled, etc. then yeah, the insurance will likely push back on continuing to pay out and she’d need to sue.
Why do you think the bottle dropper had insurance to pay OP’s ER bill? Vast majority don’t have umbrella liability.

Call your insurance company tell them the facility and that the facility has the other part's identity and contact info.

If you haven’t already, you might want to check in with a concussion program for evaluation and treatment at some point in the near future. There are several in the DMV.

It wasn’t my first thought. My first thought was ‘oh my God, what just hit my head. Am I ok’ and my second thought was that my three year old, sitting next to me, could have gotten a skull fracture and died if the bottle had been dropped six inches to the left. I asked the mom for her contact information 20 minutes after the bottle was dropped when she came down to get the water bottle. I wouldn’t have asked for her information if she hadn’t come down to get the water bottle and had left. The facility is big and our kids were not in the same activity - I had never seen her before.
It’s in incredibly poor taste to go out of your way to get a water bottle your unattended child dropped on someone’s head when you couldn’t even be bothered to ask the person your child injured if they’re ok. What message are you sending to your children?
