Regulations are based on legislation passed by the legislature, for example federal agencies have to figure out how to implement laws passed by Congress.  The language in the law is what the regulation is based on.  And agencies are typically not proactive - regulations typically don't come out of a vacuum, nor do they typically come from some kind of imagined grievances, they typically come about as a result of actual repeated abuses by industry or individuals.  And they typically go through executive branch review from Office of Information & Regulatory Affairs (OIRA) and rounds of review and input from the public and industry, it takes a long time.
