They actually have rules about all of this stuff - the Secretary of Defense should know about them and follow them, right?[/quote] The only time I’ve seen a service member punished for an affair under UCMJ was if the affair partner was another service member’s spouse (makes for some hard feelings at work!) or if the affair partner was also a service member and it was fraternization, or if the affair comprised their duty/mission/security. A National Gaurd solider having an affair with a civilian is unlikely to be prosecuted, which is exactly why he wasn’t.
