Which we will see when this gets thrown out in court. We live in VA, not CA. The standard to force a recall in VA is incredibly high. Tholen may have made questionable decisions, but she didn’t do anything overtly criminal. Sure, you can argue until you are blue in the face that she should have voted to open schools, but given that other board members agreed with her and you know..ongoing pandemic, murkey advice from public health officials, the case is mighty thin. [/quote] It may get thrown out in court; much depends on the judge to whom the case is assigned. However, the standard for removal under Virginia law is much lower than that needed for a criminal conviction - a public official may be recalled for, among other things, "neglect of duty" and "incompetence." Regardless of what happens to the recall, having over 5000 of your constituents sign a petition, in person and under penalty of perjury, attesting to the fact they think you're unfit for office is quite a rebuke.
