It may get thrown out in court; much depends on the judge to whom the case is assigned.
However, the standard for removal under Virginia law is much lower than that needed for a criminal conviction - a public official may be recalled for, among other things, "neglect of duty" and "incompetence."
Regardless of what happens to the recall, having over 5000 of your constituents sign a petition, in person and under penalty of perjury, attesting to the fact they think you're unfit for office is quite a rebuke.

The advice from our local health department and the AAP (and it's state chapter here in Virginia) was not murky. It was open.
