He is 17, so below the age of consent I believe. Her age doesn't matter as long as she is 18 or older. The interesting thing is, if they were both 17 he could have be prosecuted for distributing child pornography by sharing it. In fact I am sure he still could be but I don't think he is likely to press charges against himself. She must have been really into it, not to realize he was filming her. This is nothing short of VERY POOR JUDGEMENT. What could this woman be thinking? I don't get it. We of course all know what he was thinking.
The age of consent in DC is 16, so she did not break the law. He did, however, as you note, break the law by distributing a video of a minor (himself) engaged in the act.
I'm sure that there is a law against teachers having sexual relations with students.
Can you cite it?
Wiki In addition, many places have a higher age of consent if the older partner is in a position of authority over the young person such as being his or her teacher, manager, coach, parent or stepparent. This would also be true with a doctor or a psychologist or psychiatrist.
Again, can you cite the statute? The age of consent should be set to reflect local community standards. If it's 16, so be it. If it's 17, so be it. If it's 18, so be it. If it's 21, well some 18-year-olds might object. There's really no reason why one age is justifiable but another is not. However, it is important that the age of consent be unambiguous.
She is charged with first degree sexual assault on a minor. Really doesn't matter what you think. The law is clear and doesn't need to be cited since she is charged.
