If she had the forethought to yell no, she certainly could have had the forethought to compose herself and act like a professional instead of kicking the child. Even if she meant to stop the child, she should not have put her foot out to do this. It sounds like there was a witness and I’m sure if what you described had been the case, she wouldn’t be facing a felony.[/quote]
